For those unaware, Linda Gross is a 47-year-old South Dakota woman who sued Johnson & Johnson – and their Ethicon brand – after suffering painful side effects from the company’s Gynecare Prolift vaginal mesh sling. Now, in a new development, Linda is receiving justice, to the tune of $3.35 million.
Linda received her first vaginal mesh surgery in 2006, in order to treat her pelvic organ collapse. She soon began to experience mesh erosion, scar tissue, inflammation and “neurologic compromise to … structures and tissue.” Linda required a total of 18 subsequent operations to treat the damage, and continues to experience painful after-effects.
Ben Anderson, a member of Linda’s legal team, called the verdict “a strong statement to Johnson & Johnson and Ethicon that they cannot put profits before women’s safety.”
Sheri Woodruff, a spokeswoman for Ethicon, issued a statement, saying, “While we are always concerned when a patient experiences medical conditions like those suffered by the plaintiff, all surgeries for pelvic organ prolapse present risks of complications.”
The Gynecare Prolift was removed from the market last year. J&J denied that the product was being recalled, arguing instead that they were voluntarily discontinuing the device “in light of changing market dynamics…not related to safety or efficacy.”
But there are currently more than 1,800 pending vaginal mesh cases just like Linda’s, which will soon be tried as part of the ongoing multidistrict litigation in New Jersey. Linda’s recent victory may very well set the tone for the cases still to come, and it sends a message to all drug and device manufacturers.
